Heating Assessment Tool disclaimer
The online Heating Assessment Tool is provided by the Ministry of Business, Innovation and Employment (MBIE). It allows a person to enter information they have gathered about a rental premises to determine the heating capacity requirements for the main living room under the Residential Tenancies (Healthy Homes Standards) Regulations 2019 (the regulations). This tool is a ‘heating capacity calculator’ for the purposes of the regulations.
As well as determining the required heating capacity, the Heating Assessment Tool will also provide information about the type of heating device that, if installed, would achieve compliance with the heating standard.
MBIE endeavours to the best of its ability and knowledge to ensure the information generated by this tool will assist in user’s compliance with the heating standard. However, the Ministry cannot accept any liability for the accuracy of any report or information generated where the information entered by the user is incorrect or incomplete. Users must gather all required information and check it is accurate before entering the information. Misuse of the Heating Assessment Tool may cause an incorrect result and impact on a landlord’s compliance with the heating standard.
If a landlord (or their agent) is unsure about the accuracy of any information required by this tool then they should seek specific advice from an expert, such as a qualified builder or heating specialist. Experts should refer to Schedule 2 of the regulations(external link) for how to calculate the required heating capacity for the main living room.
When the Heating Assessment Tool is used correctly it is intended to presume the required heating capacity for the main living room of a specific rental premises. Any person using it in good faith is entitled to rely on the report produced as being the correct result based on the information entered.
From 1 July 2019, landlords must retain a copy of any report that is in their possession at the commencement of the tenancy or that they acquire during the tenancy. It is the responsibility of the user to provide a secure email address to send a completed report to.
All users who ignore this disclaimer do so at their own risk.
